AHMEDABAD: Nimesh Siddhpura was asked to pay Rs 22,000 per month as maintenance to his wife
Manisha by a family court in Rajkot. He came to Gujarat high court complaining that he is unable to pay this much to his wife because his salary is Rs 13,000.
After his assertion that alimony should not be higher than the income, the HC has reduced the amount to Rs 8,000 temporarily.
According to Siddhpura’s lawyer
Bhavini Jani, a family court in Rajkot passed an order on June 10 asking Siddhpura to pay Rs 22,000 per month from October 20 last year. This happened after the wife submitted before the court that his monthly income is more than Rs 50,000.
Advocate Jani submitted before the HC that the family court accepted the wife's claims without proper verification. Siddhpura's employer was examined before the family court and he said that the salary was Rs 13,000. But the court did not take this into consideration.
Justice Sonia Gokani directed Siddhpura to pay Rs 1 lakh within a month to his wife because he never paid maintenance amount to her. The court issued notice to the wife and kept further hearing later this month.
