Ahmedabad: Under attack from various corners, IPS officer and former investigator of the 2004 Ishrat Jahan fake encounter case, Satish Verma is likely to file an application on Thursday in the special CBI court seeking all the chargesheet papers.
Verma claimed that he wants copy of the chargesheets because the Centre's denial of sanction for criminal prosecution of Intelligence Bureau officials, including the then special director Rajinder Kumar and three of his subordinates "suffers from illegality and is not sustainable in law".
Four IB officials were charged by the CBI in February 2014, after it charged seven Gujarat Police officials with murder, criminal conspiracy, illegal detention and abduction of four persons including Ishrat Jahan. The CBI court has not taken cognizance of the second chargesheet due to the Centre's silence on sanction to prosecute the intelligence officers.
Verma says he has legal and factual grounds to believe that the denial of prosecution sanction is illegal. He claims that this inference is drawn from recent development where media interviews of the accused Kumar and witness in under secretary RVS Mani has provided additional causes to him "to believe that a serious and concerted attempt is being made to cause miscarriage of justice, by attempting to negate or weaken the evidence" collected during investigation.
Verma also claimed that these attempts are not only to damage evidence but also "to wrongfully shield the accused, both charged and prospective, from prosecution".
