Complainant to face prosecution for lodging 'fake FIR'

Bhopal/Jabalpur: Bhopal police, in a status report produced before an HC division bench in a criminal case registered against a Bhopal-based scrap dealer, said the FIR by the complainant, based on which the case was registered, was "forged".
The complainant will be charged under Sections 217 and 248 of BNS and prosecuted in the court of Judicial Magistrate First Class (JMFC), Bhopal. Following this, the high court disposed of the petition filed by the scrap dealer, Aadil Khan, seeking the quashing of the FIR against him. Khan, in his petition, said he was a scrap dealer and has a shop in Ashoka Garden, Bhopal.
Rohit Jogi came to his shop on Sept 9, and started demanding money. When he refused, Jogi set himself afire. He later lodged an FIR against Khan at Piplani police station. Police, without verifying the complaint, arrested him the same day.
During the hearing of his bail application in the HC, Khan produced the CCTV footage of the incident. The court, while granting him bail, asked Bhopal police to take action against the complainant in the case and produce a status report in the next hearing. Along with the bail application, Khan also filed a petition seeking the quashing of the FIR against him.
Police, in their report presented in the court of Chief Justice Suresh Kait and Justice Vivek Jain on Friday, said Jogi's report was found fake and he would be prosecuted for lodging a fake FIR under section 217 and 248 of BNS in the court of JMFC, Bhopal.
The court said, "The concerned authority has inquired into the application filed on behalf of Aadil Khan, the applicant herein, for closure along with CD. Statements of the witnesses who were present at the time of the incident have been taken, which reveal that Rohit Jogi himself poured the thinner on him and lit the fire. The CD has been seen, and a panchnama of identification of Rohit Jogi has been prepared. After having the material against the complainant, a complaint has been prepared under section 217 and 248 of BNS Act for presenting before the Judicial Magistrate First Class, Bhopal."
After examining the report, the court disposed of the petition.
