HC bail to Shahabuddin in cheating case

The Patna High Court on Monday granted bail to Siwan RJD MP Mohd Shahabuddin in a case of cheating, forgery and criminal conspiracy as somebody else had written his law papers in B R Ambedkar University examinations.

PATNA: The Patna High Court on Monday granted bail to Siwan RJD MP Mohd Shahabuddin in a case of cheating, forgery and criminal conspiracy as somebody else had written his law papers in B R Ambedkar University examinations.
A single bench presided by Justice S M Mehfooj Alam granted bail on the plea of Shahabuddin's lawyer Krishna Prasad Singh that another accused in this case has been granted bail.

Opposing the bail petition, APP Mukeshwar Dayal urged the court to assign reason for granting bail as Section 437 CrPC provides that while granting bail to any convict sentenced to life imprisonment or 10 years' rigorous imprisonment, the court must assign the reason. He said Shahabuddin has been sentenced to life imprisonment and also awarded 10 years' RI in two separate cases.
Justice Alam recorded that the government lawyer "vehemently opposed" the bail.
Warrant against varsity registrar:
A single bench presided by Justice J N Singh on Monday issued warrants for production of the controller of examination and registrar of B N Mandal University before the court on January 9, 2009, in a contempt case against them.
The order was passed on a contempt petition of Umesh Kumar and others who alleged the university authorities have not published their results of BEd examination of Muslim Minority Ahamadiya College-Katihar students despite the order of the high court. Petitioners' counsel Uday Chandra Prasad submitted that the results of BEd examinations of 1996-97 batch were held up despite the high court order to publish the same.
