HC stays disciplinary inquiry ordered against PI in Jamnagar
Ahmedabad: The Gujarat high court on Friday stayed a Jamnagar court's direction to the superintendent of police to institute a disciplinary inquiry against a police inspector for allegedly filing a criminal case in a civil dispute.
According to case details, on April 9, an additional sessions judge at Jamnagar, R V Mandani, ordered a disciplinary inquiry against Jamnagar City police inspector N A Chavda. The court did so while deciding an anticipatory bail application filed by a woman against whom Chavda was investigating charges of criminal breach of trust under the Indian Penal Code (IPC). The court sought a primary compliance report of its order within one month and a final report after six months.

Chavda approached the HC, and his advocates Rahul Sharma and Utkarsh Dave submitted that the lower court acted against the settled proposition of law. They relied on the Supreme Court's order in the case of Union of India vs Man Singh Verma and argued that such directions cannot be passed by a court while deciding an anticipatory bail application.
After the preliminary hearing, Justice D A Joshi stated, "In view of the rival submissions canvassed by learned advocates for the parties, issue notice upon the respondents (Chavda) returnable on June 30, 2025." The HC stayed the lower court's order till then.
