CJ concerned over pendency of cases in Raj HC

Jaipur: The Chief Justice of Rajasthan High Court, Justice MM Srivastava, Wednesday expressed concern over the pendency of cases in the high court and the shortage of judges.
Addressing lawyers at a felicitation ceremony by Rajasthan High Court Bar Association, Kustice Srivastava said the pendency of cases in the high court is no secret and that the number of judges available currently is not sufficient to handle the cases undergoing pendency for a long time. The situation has resulted in a heavy caseload for each judge currently at work in the high court, he said.
HC reserves verdict under Marriage Act
Jaipur: Hearing a case regarding the nature of maintenance orders issued under Section 24 of the Hindu Marriage Act, Rajasthan High Court reserved its decision on Wednesday.
A bench consisting of Chief Justice MM Srivastava, Justice Mahendra Goyal and Justice Sudesh Bansal was hearing the case. The legal question referred to the larger bench was whether the maintenance order under Section 24 of the Hindu Marriage Act is considered an interim order or a final order.
"If deemed an interim order, a revision can be filed against it. However, if considered a final order, it can be challenged through an appeal," said a senior advocate who sought to explain the current practice with regard to the Act.
Avoid unnecessary adjournments, PPs told
State govt Wednesday informed the HC that it has asked public prosecutors to not seek unnecessary adjournments in cases registered against MPs and MLAs in subordinate courts. The court directed govt to submit a copy of the issued order and set May 12 for the next hearing. A division bench of CJ MM Srivastava and Justice Indrajit Singh issued the order while hearing the case taken up suo motu. Advocate General Rajendra Prasad told the court that the guidelines were issued to all public prosecutors to expedite hearings of pending cases against MPs and MLAs.
