The extension, made during a general body meeting, bypassed the constitutional requirement for elections every three years.
Madras High Court orders response from Nassar, Vishal, and Karthi in Nadigar Sangam tenure extension case
In a legal challenge regarding the resolution to extend the tenure of the current office-bearers of the South Indian Film Artistes' Association (SIAA) by another three years, the Madras High Court has directed Nassar, Vishal, and Karthi to respond. A petition was filed in the High Court, seeking the appointment of a retired judge as the election officer to oversee the process of conducting fresh elections.
SIAA election framework and current office-bearers
According to the legal framework governing SIAA, elections are required to be held every three years. In the 2022 elections, actor Nassar was elected as the President, actor Vishal as General Secretary, actor Karthi as Treasurer, and actors Poochi Murugan and Karunas as Vice Presidents. These elections established the current office-bearers, whose term officially concluded in March 2024. However, the office-bearers have continued in their positions, despite the expiration of their terms.
Controversial extension of tenure
According to News 18, during a general body meeting of SIAA on September 8, 2024, the members resolved to extend the office-bearers' tenure for another three years, citing the ongoing construction of a new building for the association. This decision has sparked controversy, leading to the legal challenge. Critics argue that the extension is an unlawful decision, as it bypasses the constitutional requirement for holding elections every three years.
Legal proceedings and awaiting court’s decision
In response to the extension of the tenure, a member named Nambirajan has filed a case in the Madras High Court, asking for the resolution to be declared unlawful and invalid. The case now awaits further legal proceedings, and the court's intervention may ultimately determine the fate of the decision and whether fresh elections will be held.
