Kunal Kamra moves Bombay HC against FIR in 'Traitor' jibe case

Stand-up comedian Kunal Kamra seeks to quash an FIR filed by Mumbai police for allegedly calling Maharashtra Deputy Chief Minister Eknath Shinde a 'traitor.' Kamra's plea argues violation of fundamental rights. Despite receiving three police summons, Kamra has not appeared for questioning. Stand-up comedian Kunal Kamra has filed a petition in the Bombay High Court to quash an FIR registered against him over an alleged "traitor" remark directed at Maharashtra Deputy Chief Minister Eknath Shinde. Kamra moved the court on April 5, asserting that the FIR infringes upon his constitutional rights �?including freedom of speech and expression, the right to practice his profession, and the right to life and liberty.

The petition, filed through his lawyer Meenaz Kakalia, is expected to be heard on April 21 by a bench led by Justice Sarang Kotwal.
Kamra last month got interim transit anticipatory bail from the Madras High Court in the case against him. He is a permanent resident of Tamil Nadu.

The comedian has failed to appear before the Mumbai police for questioning despite three summons issued to him.
During a show, Kamra had taunted Shinde, without taking his name, using a modified version of a Hindi song from the film "Dil To Pagal Hai" where he called him a "gaddar" (traitor).
The comedian went on to joke about how Shinde rebelled against Uddhav Thackeray.
Following a complaint by Shiv Sena MLA Murji Patel, the police here registered the FIR against Kamra under Bharatiya Nyaya Sanhita sections 353(1)(b) (statements conducing to public mischief) and 356(2) (defamation).
